Delivering for Clients When the Stakes are High: Mid-Year Protek Highlights

Jun 3, 2026 | Informational

Organizations (and individuals) of all types and sizes, and the legal counsel who advise them, call on Protek when confronted with the wide range of challenging matters that they face where digital evidence and cyber resources are implicated, or are even the target of bad actors.

The substantive scenarios are varied: defecting employees, internal/external fraud, government inquiries/investigations, hostile workplace allegations, and vehicular and workplace accidents, just to name a few.

Whatever the scenario, Protek’s veteran experts respond quickly to handle the full range of required tasks, from identifying and preserving critical digital evidence in and from whatever form or source, conducting expert analysis to deliver clarity, producing clear and concise reports, through to providing persuasive expert witness testimony.

The first half of 2026 was no exception. Below are highlights of just a few of the matters where Protek’s experts delivered for our clients.

Managed Services Firm – Expert Witness Jury Trial Testimony

Protek provided expert witness jury trial testimony detailing our digital investigation and analysis in our client’s successful bid to enforce trade secret protections and contractual claims. Protek worked hand-in-glove with outside counsel from day one, scrambling to expedite forensic evidence preservation, conducting forensic analysis of data exfiltration pinpointing files and programs surreptitiously accessed by defendants as well as USB device usage, through to critiquing the opposing expert’s reports to prepare for opposing expert’s cross-examination, and ultimately providing compelling testimony as a court-qualified expert in our client’s jury trial win.

Prominent National Political Organization – Internal and External Investigation

Following a series of unfounded and hostile social media and public relations attacks that appeared to be coordinated and potentially fueled by leaked and manipulated information, outside counsel for a prominent national political organization (NPO) engaged Protek to investigate the source of the leaks and preserve evidence related to the defamatory campaign.

Protek immediately deployed a team on-site to perform expedited forensic imaging of mobile phones and MacBook computers, while a second team collected and preserved social media content, web-based email, and cloud-stored documents. Through forensic analysis, Protek identified connections between internal and external actors involved in the campaign, providing counsel with evidence to pursue accountability as the client deemed appropriate.

International Food Manufacturing Conglomerate – Embezzlement and Self-Dealing

A global food manufacturer suspected employees of manipulating raw ingredient inspections by improperly rejecting acceptable materials as substandard, purchasing those materials at steep discounts through a shell company, and then reselling them at full market value.

The company’s outside counsel, a former Assistant United States Attorney (AUSA), engaged Protek to assist with the investigation. Protek conducted advanced forensic collections of mobile devices, forensic imaging of laptop computers, and remote collections of employee email accounts. Through its analysis, Protek recovered previously undiscovered text messages and emails that revealed a broader scheme than initially suspected. Protek also worked closely with the forensic accounting firm retained in the matter to help document the scope and financial impact of the fraud.

Midwest IT Operations and Infrastructure Services Firm – Trade Secrets & Unfair Competition

At the direction of outside counsel, Protek assisted a corporate client and an individual employee accused of receiving a competitor’s proprietary information after hiring a former employee of that competitor.

The competitor alleged that confidential information had been transferred to personal computers, mobile devices, email accounts, and cloud storage belonging to both the individual and the corporate client. Protek worked with counsel to design a thorough, proportionate, and defensible search and remediation strategy and then executed that plan. Counsel presented Protek’s findings to opposing counsel and used the report, together with the retention of Protek’s experts, to demonstrate the client’s serious and proactive response to the allegations, helping avoid litigation by the competitor.

Top-Ten Ranked University – Personal Injury/Cause of Death Investigation

Outside counsel for a top-ten ranked university retained Protek to assist in the defense of a wrongful death claim involving a contractor who was found deceased from unknown causes at the site of a major facilities project.

Protek was engaged to evaluate the decedent’s mobile phone and determine whether electronic evidence could provide insight into the cause of death. Protek advised counsel regarding the acquisition of detailed cellular service provider records and identified deficiencies in the manner in which the decedent’s phone and data had been produced by the estate, including potential spoliation concerns. Protek subsequently performed a full file system forensic collection and analysis of the device, addressing both evidentiary preservation issues and substantive questions related to the cause-of-death investigation.

ACLU – Cruel & Unusual Punishment Litigation

Protek was retained by the ACLU to support litigation involving allegations of inadequate medical care within a state Department of Corrections system.

Protek assisted with the collection and production of electronic records and advised counsel regarding the form and structure of electronically stored information. The team also performed complex analyses of large volumes of fragmented inmate records across multiple correctional facilities and systems, helping counsel identify meaningful patterns and assess compliance with inmate medical treatment requirements.

While every engagement presents unique challenges, a common thread runs through each: the need for experienced investigators who can move quickly when the stakes are high. Protek helps clients uncover the facts and transform complex digital evidence into meaningful results.
